Energy Assessors and Home Inspectors Policy Endorsement Run Off Extension

The insurer of the policy is Tokio Marine Kiln Syndicates Ltd (through Anglo Pacific Consultants (London) Ltd).

Type of insurance and cover

Your Energy Assessors & Home Inspectors Policy contains Public & Products Liability and Professional Indemnity covers.   As an Approved Person, this can include Your work in respect of Air Conditioning System Inspection Reports (available for Per Click or Annual Policy).  It can also include CAD floor plans in conjunction with an EPC (Per Click or Annual Policy), or independent CAD floor plans (Annual Policy only)

Public and Products Liability

Cover, features and benefits

Protection against your legal liability for accidental personal injury to third parties and damage to their property including obstruction, trespass, nuisance or interference with any right of way, air, light or water.

Cover also includes:

  • Contingent motor third party liability arising out of the use of vehicles not owned by you within the UK
  • Legal liability for accidental damage to employees’ and visitors’ personal belongings, which are in the custody or control of the insured
  • Personal liability of employees and directors whilst they are oversees on your business
  • Liability for loss of or damage to premises hired or rented to you for the purpose of your business
  • Legal costs and expenses in defending prosecutions under relevant health and safety legislation.

Exceptions and limitations

  • Cover for acts of Pollution or Contamination is limited to £2,000,000 for all events
  • Loss or damage to property in your custody of control or to products supplied
  • Liability arising out of products supplied in the knowledge that they could affect the navigation, propulsion or safety of any aircraft or other aerial device
  • Pollution or contamination other than caused by a sudden, identifiable, unintended and unexpected incident which occurs in its entirety at a specific time and place
  • Work in or on or travel to or from or within products supplied to any offshore installation or support vessel
  • Liquidated damages, penalty clauses, fines or punitive damages
  • Exposure to, inhalation of, fears of the consequences of exposure to/inhalation of, costs incurred in repairing, removing, replacing, recalling, rectifying, reinstating, or managing any property arising out of the presence of Asbestos.
  • The first £250 of each and every claim in respect of third party property damage and loss of or damage to premises hired or rented.

Professional Indemnity

Cover, features and benefits

  • Claims arising out of the conduct of your business for any civil liability
  • Awards made by an ombudsman including the Ombudsman for Estate Agents
  • Awards made by an arbitrator including an arbitrator appointed under the Surveyors & Valuers Arbitration Scheme
  • Adjudicator awards made under the Housing Grants Act

Cover also includes:

  • Fidelity – loss of insured’s own money or property through employee dishonesty. Limited to £250,000 in any one period of insurance
  • Documents – costs incurred to restore or reinstate lost or damaged documents under the insured’s control.  Limited to £25,000 for any one occurrence and £100,000 in total in any one period of insurance
  • Estate Agents and Health & Safety Legislation legal costs – costs incurred in the defence of proceedings brought against the insured under certain statutory legislation such as Property Mis-descriptions Act, Health and Safety at work Act, Estate Agents Act, Construction Design and Management Regulations.  Limited to £100,000 in total in any one period of insurance.
  • Other Costs – costs incurred in defending a claim.
  • Payment for Court attendance – compensation if attending court as a witness when defending a claim.  Up to £250 per person per day limited to a total of £10,000 in any one period of insurance.
  • Representation Costs – costs incurred for representation at hearings and tribunals relating to matters that may become a claim under the policy.  Limited to £15,000 in any one period of insurance

  • Those civil liabilities not normally covered by a professional indemnity policy – Employers Liability, Public Liability, Products Liability, Property Owners, Directors and Officers, Motor, Marine, Aviation
  • Express warranties or guarantees; fines or penalties or any punitive or exemplary damages
  • Claims instituted or pursued in the USA or Canada; war & terrorism; date recognition; financial services; market fluctuations
  • The first £250 of each and every claim.

Duration of policy

The policy will remain in force for 12 months from date of commencement, or as otherwise shown on your policy schedule.

Right of cancellation

If you are an individual/sole trader (including a partnership in England and Wales) buying a policy which provides cover for you in both a private and business capacity, you have the right to cancel your policy during a period of 14 days either from the day of purchase of the contract or the day on which you receive your policy documentation, whichever is the later. Duration of policy

Where the appropriate premium is paid in respect of a Certificate or Advisory Report, cover will remain in place for a period of seven years from the date that the Certificate or Advisory Report is issued (a one year annual Policy plus six months run off thereafter).

For Domestic Assessors who have purchased insurance via Enterprise Insurance Services Ltd in the past, cover will include claims arising in respect of all past certificates, which were insured via Enterprise Insurance Services Ltd, provided the claim occurs and is notified within seven years from the date that the Certificate or Advisory Report was issued.

For Domestic Assessors who have not purchased insurance via Enterprise Insurance Services Ltd in the past, but have paid an additional premium in order to include all past certificates, cover will include claims arising in respect of all past certificates, provided the claim occurs and is notified within seven years from the date that the Certificate or Advisory Report was issued.

Right of cancellation

If you are an individual/sole trader (including a partnership in England and Wales) buying a policy which provides cover for you in both a private and business capacity, you have the right to cancel your policy during a period of 14 days from the day that the Energy Certificate or Advisory Report is issued.
